WHAT IF SOMEONE FOLLOWS YOU CONTINUOUSLY?

Whether you are walking or driving and you feel you are being followed, it’s important to stay safe.  Follow the tips below:-

  1. Call the police immediately. If you think you are in immediate danger, please do not hesitate to contact the police. 
  2. Go to a place where there are people around. Instead of walking or driving home, perhaps you could go to a coffee cafe. Crowds can deter stalkers from continuing to follow you.
  3. Change your route. People do make wrong turns. But it does not make sense that two people make a wrong turn at the same time. If this happens, head to a public place or nearby police station.

WHAT ARE YOUR RIGHTS AS EMPLOYERS OVER EMPLOYEES IN MALAYSIA?

Under the Employment Act 1955, the Employers in Malaysia have the right to manage, direct, and enforce discipline fairly, in line with the law, to ensure harmonious work relations. 

These rights include:

  1. Employers have the right to manage their organization, including hiring, transferring, employing, and dismissing employees, as long as it complies with the law.
  2. Employers have the right to terminate an employee’s service with proper notice and valid reasons, in accordance with labor laws.
  3. Employers have the right to enforce disciplinary actions fairly, in line with the law and employment contracts.

WHAT ARE MY RIGHTS AS A TENANT?

Renting a house or room is a big responsibility. Therefore, you need to understand your rights as a tenant under the law. According to the Hire-Purchase Act 1967, here are some basic rights for tenants:

  1. The right to enjoy privacy in the house without unwarranted interference from anyone, including the landlord.
  2. The right to live in a safe and healthy dwelling.
  3. The right to receive a notice of rent increase from the landlord.

CAN YOU REMAIN SILENT WHEN QUESTIONED BY THE POLICE?

When the police are investigating a case and think you have information or knowledge about the case, they may examine you and take down your answers in a 112 statement. 

In giving a 112 Statement, you may choose to refuse to answer any question that could expose you to a criminal offence. This is basically the right to remain silent according to Section 112(2) of Criminal Procedure Code (Amendment) Act 2023.

DO POLICE OFFICERS NEED TO TELL THE REASON OF YOUR ARREST AS SOON AS POSSIBLE?

The police officer must inform you why you are being arrested either while arresting or immediately after they arrest you. This is as outlined under Article 5(3) of the Federal Constitution

This provision is a constitutional right as the Federal Constitution is the supreme law of Malaysia, other laws which attempt to interfere with a constitutional right may be declared invalid.
