Aggravated Damages
Awarded when the injury inflicted on the plaintiff is enhanced by the conduct of the defendant. It is not intended to punish the defendant but it serves to compensate the plaintiff for the mental distress suffered arising from the tort.
Exemplary Damages
Awarded for cases when the courts find the actions of the wrongdoers to be reprehensible and a conscious complete disregard of another’s rights. It is not compensatory but as a punishment and to deter the defendant from repeating his act in the future.
