Jika suatu perceraian dimohon di mahkamah dengan alasan wujud perzinaan antara pasangan dengan orang ketiga, orang ketiga tersebut mestilah dijadikan sebagai pihak dalam kes tersebut melainkan mahkamah memberi izin pengecualian.
